Promotional, public debate on the new legal solutions in the field of geodesy, survey, real estate cadastre and keeping registers

The Agency for Real Estate Cadastre on June 9, 2022, held an expert debate, in cooperation with the Ministry of Justice, on the new legal solutions in the field of geodesy, survey, real estate cadastre and keeping registers. The Draft Law on Geodetic Activity and the Draft Law on Survey, Real Estate Cadastre and Registers were reviewed, which are legal solutions that were thus far united by the existing Law on Real Estate Cadastre. These new legal solutions should bring easier procedures for the citizens, improved services for the business community and the professional users.

According to the Deputy Minister of Justice, Agim Nuhiu, the need for reform in this area is necessary to respond to the changes in the geodetic area. He said: “Today, the public expert debate on the new law began because there is a need for legal certainty, i.e., to have a legal order that will be clear and non-contradictory when it comes to property issues. Other public debates will follow, and then we will initiate a procedure in the Government, after which the laws will go through parliamentary procedure”.

The Director of the Agency for Real Estate Cadastre, Boris Tundzev, pointed out that this is a completely new solution that differs in several segments from the existing law: “Citizens will be able to file an appeal in second instance proceedings, which was not the case until now and they were exposed to unnecessary court fees, with proceedings before the Administrative Court that lasted too long. We in the Agency for Real Estate Cadastre provide new services and introduce completely new solutions for performing the geodetic activity that will bring innovations in this profession in the country.

We will have several more debates with professional associations and users in order to prepare new, quality legal solutions. All opinions, views and suggestions should contribute to the improvement of the proposed legal solutions and be in the interest of the citizens and the business community. The registration procedure connects several entities, such as municipalities, ministries, notaries, enforcement agents and all this is related to the property right holders and the cadastre as a public logbook.”

The adoption of the Law on Geodetic Activity will lead to full harmonization with the directives of the European Commission, although the Agency for Real Estate Cadastre has implemented many of the directives related to spatial data. The functioning of the private geodetic activity will also be harmonized, and the digital processes in AREC will be modernized. Thus, the main benefits of the new regulations will be easier procedures for the citizens, more efficient services for the business community and innovations and higher quality in the digital operations and services of the Agency for Real Estate Cadastre.
