Registering real estate in the real estate cadaster that remained with unregistered rights

The registration of unregistered rights to real estate upon established cadaster is done for real estate that remained with unregistered rights during the systematic registration (unexposed).

The registration of real estate that remained unregistered is performed by submitting an application for registration, to which the legal basis for registration is enclosed in accordance with Article 174 of the Law on Real Estate Cadaster, surveyor’s report and proof of paid fee.

If an application is resubmitted because a previously submitted application for the same real estate was denied, to the application.

Proof of paid fee is not enclosed for the real estate that is within the procedure for systematic registration of rights to real estate, the holder of the right responded to invitation or submitted an application for registration, and such real estate remained with unregistered rights, and if the subject of registration is land with no facility built upon it, a surveyor’s report is not enclosed to the application.

For real estate with unregistered rights located in cadaster municipalities for which the real estate cadaster was established based on surveying of the land cadaster, if the subject of registration is land with no facility built upon it, a surveyor’s report is not enclosed to the application.

For real estate with unregistered rights located in cadaster municipalities for which, prior to the entry into force of the real estate cadaster, the land cadaster was applicable, established based on census (census cadaster), for which it will be determined that the holder of the right was recorded in the relevant census block, only the legal basis for registration is enclosed to the application for registration. If a facility has been built on the land, a surveyor’s report is also enclosed to the application.

For real estate with unregistered rights located in cadaster municipalities for which, prior to the entry into force of the real estate cadaster, the land cadaster was applicable, established based on census (census cadaster), for which it will be determined that the holder of the right was recorded in the relevant census block, and for the cadaster parcel and the facilities data were not collected during the surveying, only the legal basis for registration and the surveyor’s report are enclosed to the application for registration.

  • Legal basis for registration in accordance with Article 174 of the LREC:
  • law,
  • legally effective court decisions,
  • decisions on temporary measures, previous measure and other acts for securing receivables in accordance with the law,
  • decision of the Government of the Republic of Macedonia,
  • final, i.e. legally effective acts of state authorities (effective decision on privatization of construction land in state ownership, decision on expropriation, etc.), of bodies of local self-government units and the City of Skopje (decision on determining the legal status of illegally constructed facility, construction permit with complete construction-technical documentation, etc.), legal and other entities entrusted by law to perform public duties (notary public, debt collector, bodies of local self-government units – municipalities and the City of Skopje),
  • legal documents (contract on purchase/gift/physical division/exchange, life support, decision on inheritance, etc. registered with the competent body of the Public Revenue Office with proof of paid real estate sale tax), and
  • statements verified by Notary Public to serve as basis for registering the rights to the real estate, or accepting a newly defined boundary line and accepting the actual status given at a certified surveyor as integral part of the surveyor’s report, whose submission is defined as mandatory with this or another law
  • as an exception from paragraph (1) of Article 174 in the procedure for registering the real estate that remained with unregistered rights, if there are no bases from paragraph (1) of this Article, the right to ownership of land and the right to ownership of the facilities, starting from the ground floor, which were recorded in the land cadaster, will be registered based on the data from the land cadaster.
