Change of personal and address data

Legal basis: Certificate/ confirmation for one and the same person from Ministry of Interior/Municipality, Certificate from the Registry of births/deaths/marriages or confirmation from the Ministry of Justice and such, Certificate of address and house number from the City of Skopje

Registration on the basis of a solemnized purchase and sale agreement or notary act, with a clause for paid advance tax on real estate sale

Legal basis: solemnized purchase and sale agreement or notary act with a clause for paid advance tax on real estate sale, a report on the assessment of the market value of the real estate and calculation of an advance sales tax prepared by an authorized appraiser, as well as a filled out advance tax return.

Pre-registration as a conditional registration of a cadastral parcel

Legal basis: Pre-Agreement/ Agreement in writing and certified/ solemnized by a notary public without a regulated proof of sales tax, effective court verdict without regulated sales tax and others)

Deletion of the pre-registration as a conditional registration of a cadastral parcel

Legal basis: Agreement in writing and certified/ solemnized by a notary public without a regulated proof of sales tax, effective court verdict without regulated sales tax and after the expiration of the period of 6 months upon the application of the performed pre-registration, upon the application of the holder of the right of ownership or ex officio, is deleted.

Legal basis:solemnized purchase contract or public notary act, with clause for advanced payment of real estate sale tax, report on market value estimate of the real estate and calculation of the sale tax to be paid in advance, prepared by a certified assessor, as well as filled-in advance tax report.

Recording as conditional registration of cadaster parcel 

Legal basis: Preliminary contract/ Contract prepared in writing and certified/ solemnized by notary public, without regulated proof of sale tax, effective court ruling without regulated the sale tax, etc.)

Deletion of performed recording as conditional registration of cadaster parcel

Legal basis: Contract prepared in writing and certified/ solemnized by notary public, with regulated proof of sale tax, effective court ruling with regulated sale tax, and following the expiry of period of 6 months following the application from the performed record-keeping, upon the report from the holder of the right to ownership or ex officio, shall be deleted.

Updating data in the Real Estate Cadaster 

When changes are not made in the boundary line and the area of the cadaster parcel register in the real estate cadaster, with rights expressed in ideal rights arising from various techniques and methods of surveying and measuring, and their total area does not exceed 5% of the total area of the parcel, the data is updated upon reports fromclients. Statements of consent given by the holders of the rights registered in ideal parts or from the legal successor of the deceased holder of rights, certified by notary public, shall be enclosed to the application.

Application for changing the right to use undeveloped construction land to right to ownership by force of law 

The applications for changing the right to use undeveloped construction land to right to ownership by force of law may be submitted by 31st December 2022 at the latest. Natural persons need to enclose the following with their applications:

  • Proof of identity of the submitter of the application (photocopy of personal ID card or passport);
  • The legal basis, i.e. the act that served as grounds for acquiring the right to use the cadaster parcel that is undeveloped construction land, to which the application applies (law, ruling, contract, decision, resolution of competent state authority, property list, etc.);
  • Proof submitted before the body in charge of determining the legal status of illegally constructed facilities, that an application for determining the legal status of facility on a cadaster parcel that is undeveloped construction land, to which the application applies and
  • Proof of paid fee for the property list for the cadaster parcel, for certificate of history of performed registrations in the real estate cadaster and for registering in the real estate cadaster.
