Registering changes in the maintenance of the Real Estate Cadaster with surveyor’s report

Registering changes in the maintenance of the Real Estate Cadaster applies to:

  • Physical division of cadaster parcel/ privatization/ purchase/ gift/ exchange of part of cadaster parcel
  • Expropriation of cadaster parcels
  • Merging cadaster parcels
  • Registering change of cadaster culture and class
  • Deleting buildings and other facilities
  • Registering internal area / open area/ volume of newly constructed buildings, additions, upgrades, legalization of buildings and other facilities
  • Updating data on boundary lines and area of cadaster parcel
  • Updating the internal area /volume of buildings, special and common parts of buildings and other facilities

Legal basis: Contract, court decision, decision (permit) from competent authority, construction-technical documentation, statement verified with Notary Public, surveyor’s report prepared by a private surveying company or individual contractor, proof of paid fee for the service in line with the Pricelist.

Pre-registering future building

Legal basis: Legally effective construction permit verified by the competent authority and submitted by the competent municipality electronically.

Changes in pre-registering ongoing construction

Legal basis: Decision on changes to ongoing construction and construction-technical documentationsubmitted by the competent municipality electronically.

Updating the data in the real estate cadaster – ex officio

The updating of the data in the real estate cadaster ex officio is done for the holders of the rights to the cadaster parcels that are registered in the real estate cadaster with the rights expressed in ideal parts, that arise from the various techniques and methods of surveying and measuring, and their total area does not exceed 5% of the total area of the parcel.

The data updating is performed so that the Agency ex officio and free of charge deletes the holders of the rights defined in paragraph (1) of this Article.

Updating the data in the real estate cadaster – upon report from a client

The updating of the data in the real estate for the holders of the rights to the cadaster parcels that are registered in the real estate cadaster with the rights expressed in ideal parts, that arise from the various techniques and methods of surveying and measuring, and their total area does not exceed 5% of the total area of the parcel, can be made even upon a report from a client.

To register changes in the real estate cadaster, or a change in the boundary line in the cadaster plan, you need to visit a front desk in the Center for real estate cadaster Skopje or a Regional Office for real estate cadaster in AREC, and submit the following:

  • Written report,
  • Legal basis for registration
  • Statements on consent for accepting the newly defined boundary line and area of the cadaster parcel signed by the holders of the rights to the neighboring cadaster parcels to whom the ceding of the boundary lines was determined or by one of the legal successors of the deceased right holders. If the cession of the boundary line is towards a parcel that is subject of updating, not to the neighboring cadaster parcels, where their area is reduced, the statements on consent for accepting the newly defined boundary line and area of the cadaster parcel do not need to be enclosed to the surveyor’s report. The difference in the area obtained as the result of the ceding is attached to the neighboring cadaster parcels and registered as right to ownership to the holders of the rights to the neighboring cadaster parcels.
  • Surveyor’s report from surveying (updating) prepared by a private surveying company,
  • Proof of paid fee for the service in line with the Pricelist.

Updating data on internal area of buildings, special and common parts of buildings and other facilities 

When the subject of data updating are the data on the internal areas of buildings, special and common parts of buildings and other facilities registered in the real estate cadaster for which data were not collected during the surveying or the registration was not performed based on the collected data, a surveyor’s report is enclosed to the report, as well as proof of paid fee for the registration. The legal basis for updating that is being use is the legal basis for registering the right to the real estate, and the updated area is registered on the current holder of the right registered in the property list.

Registering real estate for which there were false records in actual parts in the land cadaster 

  • Report from a client,
  • Surveyor’s report
  • Statement on consent for accepting the actual status provided by the holders of the rights to the real estate that were recorded as the result of false records in the land cadaster, verified with Notary Public.
